Eli’s World Famous Boarding Co. Company Client Agreement

This is a contract between Eli’s World Famous Dog Boarding Co. Company and/or Eli’s World Famous Dog Boarding Co. (hereinafter referred to as “Facility”) and the pet owner whose signature appears above (hereinafter referred to as Owner”).

Owner certifies the accuracy of all information Owner has conveyed about Owner’s pet to the Facility.
Owner specifically represents to the Facility that Owner’s pet has not been exposed to rabies, distemper or any other contagious or communicable disease within a thirty day period prior to being left for boarding, day care or grooming. Owner agrees to notify Facility of any exposure to any virus, infection or other transferable illness and will not bring pet to Facility until pet is symptom free for a reasonable period to be determined by pet’s veterinarian or until written approval is obtained from a veterinarian. Owner further agrees not to bring the pet to Facility if the pet is exhibiting any signs of illness that may be harmful to the other dogs in attendance, such as: vomiting, diarrhea, extreme lethargy, etc. without first obtaining approval from the Facility.
Owner agrees to pay the rate for day care and/or boarding in effect on the date Owner checks Owner’s pet into the Facility as listed in the Facility.
Owner acknowledges that the dog(s) listed above is/are permitted to be co-mingled with other dogs during group play and/or group exercise if the Facility, in its sole discretion, determines that your dog(s) is/are eligible for such activities.
Owner agrees that if Owner’s pet becomes ill or if the state of the pet’s health otherwise requires professional attention, the Facility, in its sole discretion, may engage the services of a veterinarian or administer medicine or give other requisite attention to the pet and the expenses thereof shall be paid by the Owner. Owner gives consent to the Facility to act on the Owner’s behalf in obtaining emergency veterinary care at the Owner’s expense if deemed necessary by the Facility or any of its employees. Owner agrees to indemnify and holds the Facility and its employees harmless from said expenses.
Owner agrees to pay all charges for special services requested, all veterinary costs for pet during the time said pet in the care of the Facility, and all fees incurred by Owner through Owner’s failure to comply with the Facility’s Cancellation Policy.
Owner agrees that the Facility may collect amounts owed by Owner due to Owner’s failure to comply with the Facility’s Cancellation Policy by charging such amounts to Owner’s credit card (data concerning which Owner has supplied to the Facility). All other charges incurred by Owner shall be payable upon pick-up of Owner’s pet, or when billed by Facility at the address of Owner listed in this Contract. Owner further agrees that the Facility shall have the right to refuse to release Owner’s pet to Owner until Owner has paid all charges due from Owner to Facility.
Owner hereby grants the Facility a lien on Owner’s pet for any and all unpaid charges resulting from boarding, day care or any other service provided by the Facility.
Owner assumes any and all expenses or liability for injuries that Owner’s pet may inflict upon any human or other pet while in the Facility. Owner agrees to indemnify and holds the Facility and its employees harmless from any and all expenses and liability incurred as a result of injuries Owner’s pet inflicts upon any human or other pet while in the Facility.
Owner hereby grants the Facility the right to take photographs of Owner’s pet while the Facility is caring for Owner’s pet and to post or reproduce any and all photographs taken (as well as Owner’s pet’s name) on or in, without limitation to, the Facility’s web site, promotional materials and merchandise, without becoming liable to the Owner (or the Owner’s pet) for any royalty payment of any kind. Owner hereby releases, covenants not to sue, and forever discharges the facility of and from any and all claims, demands, rights and causes of action of whatever kind or nature including, but not limited to, appropriation of the picture or name of owner’s per for commercial advantage, publication of facts placing the owner and /or owner’s pet in a false light, and public disclosure of private facts about the owner and/or owner’s pet, arising out of or relating to any photographing of or use of photographs of pern’s pet pursuant to the authority owner has granted the facility in the sentence immediately preceding this sentence.
The Facility shall exercise reasonable care for Owner’s pet while Owner’s pet is in the Facility’s custody. The Owner recognizes the potential risks involved with group play/dog daycare, boarding, and grooming due to the unpredictable nature of dogs.
Facility reserves the right to change the level or type of daycare/boarding or remove the pet from group play, if in its sole discretion it is believed necessary to ensure the safety of the pet, other dogs or its employees.
Owner expressly agrees that facility’s liability shall in no event exceed the current chattel value of a pet of the same species as the pet delivered by owner to the facility pursuant to this contract.
This Contract contains the entire agreement between the parties. All terms and conditions of this Contract shall be binding on the heirs, administrators, personal representatives and assigns the Owner and the Facility.
Any controversy or claim arising out of or relating to this Contract , or breach thereof, or as the result of any claim or controversy involving the alleged negligence by any party to this Contract, shall by arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by an arbitrator may be entered in any court having jurisdiction thereof. The arbitrator shall, as part of his/her award, determine an award to the prevailing party of the costs of such arbitration and reasonable attorney fees of the prevailing party.

ELI’S WORLD FAMOUS DOG LODGING CO Policies

ELI’S WORLD FAMOUS DOG LODGING CO reserves the right to change your dog’s type of boarding/daycare, and/or to provide or decline additional services, if it is necessary to protect the health and well-being of your dog, other dogs, or our staff. (Additional charges may apply.)

Health ELI’S WORLD FAMOUS DOG LODGING CO will contact your Veterinarian for records regarding vaccinations and flea/heartworm preventions.

Vaccinations:
All dogs must be current on:
Vaccinations against rabies and bordatella, and
Vaccinations against or titers for distemper, parvovirus and leptospirosis.
(Note: Boarding-only dogs who are not involved in any group activity or nature walks may be opted-out of the leptospirosis vaccination requirement.)
Flea and heartworm:
All dogs must be current on flea and heartworm prevention programs.
If your dog is exhibiting any symptoms that may suggest illness such as sneezing, coughing, wheezing, runny eyes or nose, vomiting, lethargy, or diarrhea, please do not bring your dog to playcare or boarding.
Dogs with flea or tick problems will be treated at your expense.
Un-spayed females in heat are not accepted. Although we accept un-neutered males and un-spayed females (not in heat) for boarding services only, ELI’S WORLD FAMOUS DOG LODGING CO is not responsible for unplanned breeding. If your dog comes into heat while boarding, we will contact you and you will be expected to pick up your dog immediately. If you are unable to do so, you will be charged an extra $30.00 per day.

Owner acknowledges that items left with your dog(s) that are valuable or irreplaceable. ELI’S WORLD FAMOUS DOG LODGING CO is not responsible for loss or damage to any personal item, including bedding or toys, left with or for your dog(s).

Abandoned Dog Procedure Unless otherwise required by applicable law, if you fail to pick up your dog(s) by the designated time and have failed to make satisfactory alternative arrangements with ELI’S WORLD FAMOUS DOG LODGING CO, ELI’S WORLD FAMOUS DOG LODGING CO will continue to provide basic service to ensure the dog’s health and safety, and charges will continue to accrue. BUCKEYE KENNELS will make best efforts to contact you using the information you provided, advising you that if your dog(s) is not picked up within a reasonable time period, your dog(s) will be deemed to be abandoned and that ELI’S WORLD FAMOUS DOG LODGING CO will deliver the dog(s) to a third-party adoption partner or to Buncombe County Animal Control. You understand that you may lose ownership of your dog(s) under these circumstances. If you fail to pick up your dog(s) for any reason, you release ELI’S WORLD FAMOUS DOG LODGING CO from all further liability and responsibility for your dog(s). You shall remain liable to ELI’S WORLD FAMOUS DOG LODGING CO for all unpaid charges, including without limitation the court costs and reasonable attorneys’ fees incurred in the collection of such charges.

Boarding/Daycare Check-in and Check-out After-hours check-in/check-out is available by appointment only, for an additional charge.

Rates and Hours of Operation Current rates and hours of operation are posted in the office and online. ELI’S WORLD FAMOUS DOG LODGING CO reserves the right, without notice, to adjust its rates and fees for services.
Reservations and Cancellations Reservations are required for all stays. Deposits and/or cancellation fees may apply for extended stay and holiday/peak season bookings.

Representations and WAIVERS OF LIABILITY

.seI have read and understood the following:

I agree that I am the owner (or designated agent of the owner) of the dog(s) and am fully authorized to enter this agreement.
I understand and agree that ELI’S WORLD FAMOUS DOG LODGING CO is relying on my representations of my dog’s (dogs’) health and behavior. I further understand and agree that ELI’S WORLD FAMOUS DOG LODGING CO and its staff will not be liable for any health problems that develop. I agree and understand that ELI’S WORLD FAMOUS DOG LODGING CO reserves the right to deny admittance to my dog(s) at any time for any reason.
I understand and agree that ELI’S WORLD FAMOUS DOG LODGING CO will not be liable for any injuries or illnesses that occur as a result of my dog’s(dogs’) attendance, provided that reasonable care and precautions are followed.
I understand that group exercise and group play are situations where dogs co-mingle in groups, and if I have given permission to ELI’S WORLD FAMOUS DOG LODGING CO to allow my dog(s) to participate in any group activity, I understand and acknowledge that there are risks inherent when dogs co-mingle, including, but not limited to, bites, scratches and sore muscles.
I understand that ELI’S WORLD FAMOUS DOG LODGING CO is not a veterinary establishment and does not practice veterinary medicine. I understand and agree that if my dog(s) become ill or injured, of if the state of the dog’s (dogs’) health requires medical attention, ELI’S WORLD FAMOUS DOG LODGING CO, in its sole discretion, may engage the services of a veterinarian or administer medicine or give other requisite attention to the dog. ELI’S WORLD FAMOUS DOG LODGING CO staff will make their best efforts to notify me in the event of a serious illness or injury using the contact information I have provided to ELI’S WORLD FAMOUS DOG LODGING CO. I understand that I am responsible for providing updated contact information. I agree to assume full financial responsibility for any and all expenses incurred, and I release ELI’S WORLD FAMOUS DOG LODGING CO and its staff from any and all responsibility for, or claims, damages, debts, arising out of or related to such medical care, including, but not limited to, transportation to/from the veterinary clinic and choice of veterinarian and animal hospital.
I certify, to the best of my knowledge, my dog (s) has not been exposed to any communicable diseases with the past 30 days. I agree that I will notify ELI’S WORLD FAMOUS DOG LODGING COof any known exposure of my dog(s) to communicable diseases and will keep my dog(s) out of playcare and will provide a veterinary certification of fitness for playcare to be admitted or re- admitted. I also agree that I will maintain current vaccines for my dog(s) and provide certification to that effect upon initial evaluation and periodically as requested.
I authorize ELI’S WORLD FAMOUS DOG LODGING CO to obtain medical and vaccination records for my dog(s) from the veterinarian listed above, and I hereby authorize my veterinarian to provide these records to ELI’S WORLD FAMOUS DOG LODGING CO
I understand and agree that I am solely responsible for any and all acts or behavior of my dog(s) while in the care of ELI’S WORLD FAMOUS DOG LODGING CO. I release BUCKEYE KENNELS from any liability arising from my dog’s (dogs’) attendance at ELI’S WORLD FAMOUS DOG LODGING CO and accept full responsibility for any and all costs for injury to staff or other animals or damage to facilities caused by my dog(s). I hereby release ELI’S WORLD FAMOUS DOG LODGING COof any liability and I further agree to indemnify and save them harmless against any and all claims arising from my dog’s (dogs’) attendance at ELI’S WORLD FAMOUS DOG LODGING CO, including but not limited to all costs, damages attorneys fees, expenses and liabilities in connection therewith.
I understand that in an emergency event, such as a natural disaster, every effort will be made to contact me to retrieve my dog(s). I agree that ELI’S WORLD FAMOUS DOG LODGING CO, in its sole discretion, is authorized to transport and/or make temporary alternative arrangements to house and care for my dog(s) until I retrieve my dog(s).
I understand and agree that my dog(s) may be photographed, videotaped and/or recorded and that ELI’S WORLD FAMOUS DOG LODGING CO retains all rights to use, and proceeds from use of, images.
ANIMAL BOARDING ACKNOWLEDGEMENT OF RISK

In consideration of the services provided by ELI’S WORLD FAMOUS DOG LODGING CO , its officers, agents, employees, and stockholders, and all other persons or entities associated with ELI’S WORLD FAMOUS DOG LODGING CO (collectively, “Mesa Verde”), I agree as follows:
I understand that while my pet is staying with ELI’S WORLD FAMOUS DOG LODGING CO, he or she may come into contact with other pets and humans. Every effort will be made to ensure the safety of pets, but there are inherent risks involved with interactions between humans and dogs, as well as between dogs and other dogs, which may result in property damage or bodily injury, including but not limited to sickness or death; and there may be other risks not known to me or ELI’S WORLD FAMOUS DOG LODGING CO that are not readily foreseeable at this time. I understand that there are certain risks inherent in boarding my pet that cannot be eliminated. ELI’S WORLD FAMOUS DOG LODGING CO believes it is important for me to know in advance what to expect and the potential risks, and that unknown risks may exist. In the event of an injury or illness, we will make every effort to contact you. If we are unable to reach you, your pet will be taken to our local veterinary clinic.
I fully accept responsibility for these inherent risks (which may or may not be specifically identified herein). My use of ELI’S WORLD FAMOUS DOG LODGING CO is purely voluntary, and I elect to proceed hereunder in spite of and with full knowledge of the risks.
I have fully read, and understand and accept, the terms and conditions stated herein and acknowledge that this agreement will be effective and binding upon the parties during the entire period of participating in the said activity(s).

I understand that this agreement covers the current relationship between ELI’S WORLD FAMOUS DOG LODGING CO and me. Each time I bring my dog(s) to ELI’S WORLD FAMOUS DOG LODGING CO, I am affirming the terms of this Agreement and the truthfulness and accuracy of all statements I make in this Agreement.

I have read and understand this entire Agreement, I have had an opportunity to discuss it to my satisfaction with a representative of ELI’S WORLD FAMOUS DOG LODGING CO, and I agree to its terms.
